Terms of Service

Welcome to SafeRide America! These Terms of Service (“Terms”) govern your access to and use of our nonprofit driver services, mobile applications, and websites operated by SafeRide America, Inc. (“SafeRide,” “we,” “our,” or “us”). By using, registering for, or accessing our services (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

1. About SafeRide America

SafeRide America is a 501(c)(3) nonprofit organization that provides professional designated driver services. We offer a platform that connects users with trained drivers who operate the user’s own vehicle. SafeRide America is not a transportation carrier, ride-hailing company, or vehicle-for-hire service. We do not provide transportation — we provide licensed drivers to operate your vehicle for you.

2. Your Responsibilities and Acknowledgments

By using our Service, you agree:

  • To give explicit permission for a SafeRide driver (or volunteer assistant) to operate your personal vehicle.
  • That you are solely responsible for securing your vehicle and belongings after delivery.
  • That you maintain active auto insurance compliant with your state’s laws, and your policy will serve as the primary coverage for any incidents.
  • To hold SafeRide America, its directors, employees, volunteers, and partners harmless from any damage, theft, injury, or other incidents arising from use of your vehicle or the Service.

3. Registration and Eligibility

To use the Service, you must:

  • Be at least 18 years old;
  • Be legally able to form a binding contract;
  • Register and provide accurate, current, and complete information;
  • Keep your login credentials secure and report any unauthorized access promptly.

You may not use the Service if you have been previously banned, suspended, or removed.

4. Use of the Service

You agree not to:

  • Impersonate anyone else;
  • Interfere with network security;
  • Upload illegal, abusive, or harmful content;
  • Violate any applicable laws or SafeRide’s policies;
  • Use the Service for commercial purposes unless specifically authorized.

5. Rider Code of Conduct

To ensure a safe, respectful, and professional experience for everyone, all users of SafeRide America’s services must adhere to the following Code of Conduct:

  • Respect the Driver and Volunteer: No verbal abuse, threats, inappropriate language, sexual advances, or hostile behavior will be tolerated.
  • No Open Containers or Smoking: Alcohol must remain sealed. Smoking (of any substance) in the vehicle during a ride is strictly prohibited.
  • Remain Seated and Buckled: Riders must remain seated and buckled at all times while the vehicle is in motion.
  • No Illegal Substances or Weapons: Possession or transport of illegal drugs or firearms during the ride is strictly forbidden.
  • Be Responsible: Excessive intoxication that presents a safety risk or inability to communicate respectfully may result in immediate cancellation of service and a ban from future rides.
  • Damages: You will be financially responsible for any damages, spills, or cleaning fees resulting from your behavior during a ride.
  • Follow Instructions: Cooperate with the driver and follow all lawful instructions, including providing access to your vehicle and respecting pickup/drop-off logistics.

Violations of this Code may result in service refusal, account suspension, or permanent termination without refund.

6. Fees and Payments

All rides are billed based on published rates. By booking a ride, you agree to pay:

  • The applicable ride fee;
  • A driver gratuity (for excellent service);
  • Cancellation Fees

    SafeRide America does not charge a standard cancellation fee. However, we reserve the right to apply a cancellation charge in cases where a driver has already been dispatched and travel toward the pickup location has begun. Specifically:

    • If a customer cancels after a driver has been en route for more than 15 minutes, or

    • If the driver arrives at the pickup location and the customer is not present,

    Then a cancellation fee equal to the minimum fare for the service level requested may be charged. This policy ensures fairness to our drivers and volunteers who have committed time and resources to your scheduled ride.

    All cancellation fee decisions are handled on a case-by-case basis and at SafeRide America’s sole discretion.

  • Any damage, cleaning, or repair costs resulting from your actions.

Disputes must be submitted in writing within 60 days of your ride.

7. Volunteers and Community Service

SafeRide may use volunteers, including those completing court-ordered or other community service. These individuals are not employees and are not compensated in any form. By using the Service, you acknowledge and accept that your driver’s chase vehicle may be operated by a community service volunteer.

8. Limitation of Liability

SafeRide provides the Service “AS IS” and makes no guarantees regarding availability, accuracy, safety, or results. To the fullest extent permitted by law:

  • We disclaim all warranties, express or implied.
  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the greater of $100 or the amount you’ve paid to SafeRide in the past six (6) months.

9. Dispute Resolution & Governing Law

Binding Arbitration: Any disputes arising out of these Terms will be resolved through binding arbitration in Fulton County, Georgia, and not in court. You waive the right to participate in class actions.

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for any reason, including violations of these Terms or the Rider Code of Conduct.

11. Privacy

We respect your privacy. Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Changes to Terms

We may update these Terms from time to time. If we do, we will post the updated version and update the “Effective Date” above. Continued use of the Service constitutes acceptance of the new Terms.
